Caravan Sites - An Online Guide: Terms And Conditions
1 Terms
1.1 caravansites.anonlineguide.co.uk is owned and operated by Dave Turner trading as DIT Inspired marketing, from hereon in the term "AnOnlineGuide" refers to Dave Turner trading as DIT Inspired Marketing.
1.2 Any 3rd party who places an advertisement with AnOnlineGuide is hereon in refered to as an "advertiser" or "advertisers".
1.3 Any 3rd party who uses the information provided on the AnOnlineGuide website is hereon in refered to as a "user" or "users".
2 Charges
2.1 All advertisement costs are charged in Pounds Sterling. Advertising charges are for a period of 12 months of advertising from the date of payment.
2.2 Any discount given for whatever reason, it for one 12 month advertising period only. All subsequent advertising must be payed for in full unless the same or another offer is available at the time of payment.
3 Advertisement Content
3.1 AnOnlineGuide accepts advertisements in good faith and expects that advertisers will provide clear and accurate descriptions of their caravan site.
3.2 All adverts should comply with the relevant UK legislation including the Trade Descriptions Act 1968 (which covers false descriptions) and the Consumer Protection Act 1987 (which covers misleading prices). The advertiser will agree to indemnify AnOnlineGuide against all claims arising out of any misleading information in their advertisements.
3.3 Adverts MUST NOT contain any material which could be deemed to be illegal in any way, racist, violent or of an adult sexual nature.
3.4 AnOnlineGuide will periodically check all advertisements to ensure that the content is suitable for the AnOnlineGuide website.
4 Copyright
4.1 It is the responsibility of the advertiser to ensure that they have the right to reproduce any photographs or digital images used in their advertisements. The advertiser agrees to indemnify AnOnlineGuide against all claims arising out of any infringement of copyright for such photographs or images.
4.2 An Online Guide makes no claims of copyright over any material shown in any of it's adverts.
5 Liability
5.1 AnOnlineGuide cannot be held liable for any loss incurred by advertisers, including but not limited to consequential losses such as loss of income, in connection with advertising on AnOnlineGuide.
5.2 AnOnlineGuide cannot be held liable for any loss or un-satisfaction incurred by AnOnlineGuide website users, including but not limited to consequential losses such as un-satifactory holidays taken as a result of an advertisement on AnOnlineGuide. It is the responsibility of the users of AnOnlineGuide to investigate any chosen caravan site for (including but not limited to) quality, suitability for their holiday.
5.3 It is you the website users responsibility to evaluate the accuracy, completeness or usefulness of any information on or from this site. While we have made reasonable attempts to ensure that the information contained in this site has been obtained from reliable sources, AnOnlineGuide does not accept any responsibility for any (but not limited to) errors, omissions or misleading content of any kind.
5.4 All information on this site is provided with no guarantee of completeness, accuracy or of being up to date. Similarly no liability of any kind is accepted for any results obtained or consequences arising (whether direct or indirect and whether foreseeable or not) from the use in any of the contents of this site. No warranty of any kind whether express or implied including but not limited to warranties of suitability and fitness for a particular purpose are given or made in relation to the information provided by this website.
5.5 Under no circumstances does AnOnlineGuide or it's owner have any responsibility for or liability to any person or body for any decision made or actions taken in reliance on or by use of the information contained in this site. We are unable to accept any responsibility or liability in the event of a dispute between an advertiser and a user.
6 Links to Advertiser Websites
6.1 AnOnlineGuide advertisements may contain a link to the advertisers own website.
6.2 Links in this site connect to other web sites maintained by third parties. AnOnlineGuide makes no representations as to any other web site or it's content. Any opinions, advice, statements, services, offers or other information or content expressed or made available by third parties are those of the respective authors, publishers or distributors are not those of AnOnlineGuide.
6.3 AnOnlineGuide reserve the right to refuse such links, or remove them without notice.
7 Advert Refusal and Termination
7.1 AnOnlineGuide reserves the right to refuse to accept any advert submitted. In such an event, a full refund will be given. Under no circumstances will any compensation be payable by AnOnlineGuide for any loss incurred, including but not limited to, loss of income or the time/cost involved in submitting the advert.
7.2 If AnOnlineGuide receives a complaint about an advertisement, we reserve the right to remove that advertisement from our website without notice, if in our opinion the complaint is reasonably substantiated. Such complaints could relate to (but not limited bo) the accuracy of an advert, the caravan site condition, unacceptable booking conditions, lack of response to complaints. In all cases, the decision of AnOnlineGuide will be final. A refund will normally be made pro-rata for the remaining unused period of the advertisement. The remaining unused period will be the number of unused complete months before the advertisement is due to expire. The refund will be made at 1/12th of the original advertisement cost per unused month. Under no circumstances will any compensation be payable by AnOnlineGuide for any loss incurred, including but not limited to, loss of income, re-advertising costs, or time spent creating the advertisement.
7.3 The advertiser may choose to temporarily withdraw their advert from the AnOnlineGuide web-site at any time and subsequently reinstate it, this can be done from within the advertiser logon account. Please note that the period of advertising for that advert will not be extended to allow for the time when the advert was not shown on our web-site nor will any refund be made for that time.
8 Refunds
8.1 All new advertisers have the right to cancel an advert within seven days of payment. If you do cancel your advertisement within seven days you must contact AnOnlineGuide by e-mail to formally request cancellation. You will have your payment refunded within 31 days of the instruction to cancel being received.
8.2 Should you decide to cancel your advertisement after seven days but before the end of your advertisements expiration date, there will be no refund payable.
9 Service Level
9.1 AnOnlineGiode will endeavour as far as practical to ensure that our web-site is available on the internet at all times. However, some breaks in service are inevitable and often beyond our control, we therefore cannot guarantee 100% availability 365 days a year. AnOnlineGuide cannot be held liable for for any loss incurred by advertisers as a result of the un-availability of the AnOnlineGuide website, including but not limited to consequential losses such as loss of income.
